Article 2. Applicability

These General Terms of Delivery apply to all offers, orders and agreements of Green Garden. Accepting an offer or placing an order implies that you accept the applicability of these Terms. The provisions of these Terms and Conditions can only be deviated from after written notification or written approval by Green Garden, in which case the other provisions will remain in full force. All rights and claims, as stipulated in these Terms, and in any further agreements for the benefit of Green Garden, are also stipulated for the benefit of intermediaries and other third parties engaged by Green Garden. These Terms and Conditions respect the consumer's rights arising from the law (or the sales agreement).

Article 3. Offers/agreements

All offers by Green Garden are without obligation and Green Garden expressly reserves the right to change prices, in particular when this is necessary on the basis of (legal) regulations. An agreement will only be concluded after acceptance of your order by Green Garden. 
Green Garden is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Green Garden will communicate this within ten (10) working days after receipt of the order.

Article 4. Cancelling an order

Cancellations should be notified via our email address info@greengardenflowerbulbs.nl. The buyer has the right to cancel the agreement within five working days. If your order has not yet been processed, you can immediately cancel your order free of charge. If your order has already been shipped, you will be obliged to reimburse the costs incurred. The costs consist of the shipping and order costs incurred.

Article 5. Prices

The prices stated for the products offered are in Euros, exclusive of VAT and exclusive of any shipping costs.

Article 6. Delivery

The delivery time of the flower bulbs on Green Garden is tailored to the planting season. Outside the planting season, you can place an order, which will be delivered during the planting season for your region. Within the planting season, your order will be shipped within a few days to a maximum of a week. The flower bulbs are sent insured. In case of an unforeseen deviation in delivery times, you will be informed by us. If the force majeure situation lasts longer than thirty (30) days, both Green Garden and the buyer will have the option to dissolve the agreement in writing, after which both parties will be released from their obligations to each other and any payments already made will be refunded. Any delivery times stated by Green Garden are only indicative! Exceeding any delivery date will not entitle you to compensation. The delivery of the products will take place at the place and time when the products are ready for dispatch to you.

Article 7. Right of withdrawal

No legal right of withdrawal applies to fresh products such as flower bulbs in connection with perishable goods. Complaints about delivered products can only be considered if the product is damaged. If the product is delivered damaged, Green Garden should be informed of this by means of a photo within 14 days. If there is indeed damage, a suitable solution will be sought in consultation with the consumer. Severely damaged products do not have to be returned.

Article 8. Availability of articles

Flower bulbs are a natural product. Availability depends on the harvest results of our own and our suppliers' crops. Despite careful planning, it may happen that an article is unexpectedly not available or very limited. In that case, Green Garden will suggest a suitable replacement by e-mail.

Article 9. Responsibility

The customer is entirely responsible for the use of the delivered goods. Green Garden is not liable for negative consequences of injudicious, improper or incorrect use or misuse.

Article 10. Retention of title

Ownership of delivered products will not be transferred until you have paid everything owed to Green Garden under the agreement. The risk of loss of or damage to the products stated in the agreement will be transferred to the consumer at the moment they are legally and/or actually delivered and thus come into the possession of the consumer or a third party to be designated by the consumer.

Article 11. Complaints

You are obliged to examine upon delivery whether the delivered products comply with the agreement. If this is not the case, you must inform Green Garden of this as soon as possible and in any event within two (2) working days of delivery via the e-mail address info@greengardenflowerbulbs.nl.

Compliance policy

1. Introduction

Green Garden Flowerbulbs is committed to maintaining the highest standards of ethics and compliance with laws and regulations. This compliance policy aims to establish guidelines and procedures to ensure that Green Garden Flowerbulbs operates in accordance with applicable laws and regulations.

2. Anti-Money Laundering Policy

Green Garden Flowerbulbs is committed to preventing and combating money laundering. Green Garden Flowerbulbs will:

a. Customer Identification (KYC): Carefully conduct the customer identification process to establish true identity and comply with all KYC requirements.

b. Reporting of Suspicious Transactions: Immediately report suspicious transactions to competent authorities and follow internal reporting procedures.

c. Training and Awareness: Provide employees with regular training and awareness programmes to keep them abreast of the latest anti-money laundering developments.

d. Due Diligence: Conduct due diligence for suppliers and partners to ensure that they also meet the highest standards in anti-money laundering.

3. Sanction compliance

Green Garden Flowerbulbs will comply with all applicable sanction laws and regulations. Green Garden Flowerbulbs will:

a. Screen Parties: Regularly screen all business partners, customers and suppliers against national and international sanctions lists.

b. Prohibited Transactions: Not conduct transactions in violation of applicable sanctions measures, including trading with prohibited parties.

c. Training: Provide employees with regular training to make them aware of sanctions laws and regulations and equip them with the necessary knowledge to comply with them.

4. Export control

Green Garden Flowerbulbs, as a company exporting flower bulbs to countries within and outside the EU, will comply with all relevant export control laws and regulations. Green Garden Flowerbulbs will:

a. Classification of Goods: Properly classify flower bulbs in accordance with applicable export control laws. 

b. Licences and Permits: Obtain all required export licences and permits before exporting any goods. 

c. Checks: Conduct regular checks to ensure that export activities comply with applicable export control laws.


5. Monitoring and compliance

Green Garden Flowerbulbs' management is responsible for compliance with this policy. Green Garden Flowerbulbs will regularly evaluate the effectiveness of this policy and make adjustments if necessary.

This compliance policy is intended to guide all employees of Green Garden Flowerbulbs and must be adhered to to ensure that the company operates in accordance with applicable laws and regulations. Violations of this policy may result in disciplinary action, including termination of employment and legal action if necessary.
